Mapping the Common Law conference papers

The common law is broken down into divisions and subdivisions of causes of action (for example, within tort: trespass, negligence, defamation, nuisance) which generally works well. Problems arise when the same facts give rise to concurrent causes of action and when concepts from one division of common law appear in another. Mapping the Common Law explores the historical origins of the current classification of the common law; how and why the common law method of case reasoning produces a classification; the current problems; flaws and tensions in the current classification; and what changes we might expect to see in the future. Papers included were presented by Professors Peter Watts, Michael Lobban, Gerald Postema, Benjamin Zipursky, Hon Justice William Gummow and Chief Justice Rt Hon Dame Sian Elias.
